By downloading, accessing, or using the MyWear mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1.2 Eligibility

To use the Service, you must:

• Be at least 13 years of age (or 16 in the EU, or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding agreement

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

2.1 What MyWear Offers

MyWear is an AI-powered personal style assistant that provides:

• AI-powered clothing analysis and categorization
• Outfit recommendations based on weather and occasions
• Virtual try-on features
• Outfit planning and calendar integration
• Style statistics and insights

2.2 Service Availability

• The Service is provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free operation
• We may modify, suspend, or discontinue features with reasonable notice
• Scheduled maintenance will be announced in advance when possible

2.3 Geographic Availability

The Service is available worldwide, subject to:

• App Store and Play Store availability in your region
• Compliance with local laws and regulations
• Feature availability may vary by region

3. Account Registration

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access

3.2 Account Security

You are responsible for:

• All activity that occurs under your account
• Maintaining the confidentiality of your password
• Restricting access to your devices

We are not liable for any loss arising from unauthorized use of your account.

3.3 One Account Per Person

Each person may maintain only one account. Creating multiple accounts may result in termination of all accounts.

3.4 Account Sharing

Your account is personal and non-transferable. You may not:

• Allow others to access your account
• Sell, transfer, or sublicense your account

4. Subscription and Payments

4.1 Subscription Tiers

MyWear offers the following subscription options:

Prices may vary by region and are subject to change with notice.

4.2 Billing and Renewal

• Subscriptions are billed in advance on a recurring basis
• Your subscription will automatically renew unless cancelled
• Renewal occurs at the end of each billing period
• Price changes will be notified at least 30 days in advance

4.3 Payment Processing

• Payments are processed through Apple App Store (iOS) or Google Play Store (Android)
• We do not store your payment card information
• All transactions are subject to the payment processor's terms

4.4 Cancellation

You may cancel your subscription at any time:

• iOS: Settings → Apple ID → Subscriptions → MyWear → Cancel
• Android: Play Store → Menu → Subscriptions → MyWear → Cancel

Upon cancellation:

• You retain access until the end of the current billing period
• No refunds for partial periods (except where required by law)
• Your data remains accessible; you can export before downgrading

4.5 Refunds

• Refunds are handled by Apple or Google according to their policies
• We may offer discretionary refunds in exceptional circumstances

4.6 In-App Purchases (Iplik)

• Iplik is a virtual currency used for premium features
• Iplik purchases are non-refundable
• Iplik does not expire
• Iplik cannot be transferred or exchanged for cash

4.7 Free Trial

If we offer a free trial:

• Trial length will be specified at sign-up
• Payment method required to start trial
• Cancel before trial ends to avoid charges
• One trial per user

5. User Content

5.1 Definition

"User Content" includes any photos, images, text, or other materials you upload, submit, or create using the Service.

5.2 Ownership

You retain all ownership rights to your User Content. By uploading content, you grant MyWear a limited license to:

• Store and display your content within the Service
• Process your content for AI analysis
• Create thumbnails and previews
• Back up your content for service continuity

This license is:

• Non-exclusive
• Royalty-free
• Worldwide
• Limited to providing and improving the Service
• Terminates when you delete your content or account

5.3 Your Responsibilities

You represent and warrant that:

• You own or have rights to all content you upload
• Your content does not infringe any third-party rights
• Your content complies with these Terms and our Acceptable Use Policy
• Your content does not contain malware or harmful code

5.4 Content Removal

We reserve the right to remove content that:

• Violates these Terms or our policies
• Is illegal or promotes illegal activity
• Infringes intellectual property rights
• Is reported and confirmed as inappropriate

5.5 No Monitoring Obligation

We are not obligated to monitor User Content but may do so to:

• Ensure compliance with our policies
• Respond to legal requirements
• Protect our rights and users' safety

6. Acceptable Use

6.1 Permitted Use

You may use the Service only for:

• Personal, non-commercial wardrobe management
• Creating and planning outfits
• Receiving style recommendations
• Other features as intended

6.2 Prohibited Conduct

You agree NOT to:

• Upload content depicting illegal items
• Facilitate or promote illegal activities

Harmful Content

• Upload content that is obscene, pornographic, or sexually explicit
• Upload content depicting violence, abuse, or self-harm
• Upload content that harasses, threatens, or intimidates others
• Upload content that promotes discrimination or hate

Intellectual Property Violations

• Infringe copyrights, trademarks, or other IP rights
• Upload counterfeit product images for commercial purposes
• Remove or alter any proprietary notices

Technical Abuse

• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated tools (bots, scrapers) without permission
• Reverse engineer or decompile the application
• Circumvent security features or access restrictions

Commercial Misuse

• Resell or commercially exploit the Service
• Use the Service to build a competing product
• Scrape data for commercial purposes

Impersonation

• Impersonate any person or entity
• Falsely claim affiliation with any organization
• Create accounts for others without authorization

6.3 Enforcement

• Account suspension

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for personal purposes
• Download and install the mobile application
• Use features according to your subscription tier

7.3 Restrictions

You may not:

• Copy, modify, or distribute the Service
• Create derivative works
• Decompile, reverse engineer, or disassemble
• Remove proprietary notices
• Use trademarks without authorization

7.4 Feedback

If you provide feedback, suggestions, or ideas:

8. AI-Generated Content

8.1 Nature of AI Features

MyWear uses artificial intelligence for:

• Virtual try-on image generation
• Outfit recommendations

8.2 AI Limitations

You understand and agree that:

• AI recommendations are suggestions, not professional advice
• Results may not always be accurate or suitable
• AI cannot replace personal judgment
• Virtual try-on images are simulations, not exact representations

8.3 Ownership of AI Outputs

• AI-generated categorizations and metadata remain part of your data
• Virtual try-on images are generated for your personal use
• You may save and use AI outputs within the Service
• Commercial use of AI outputs requires separate authorization

8.4 AI Training

• We do not use your personal photos to train AI models
• AI analysis is performed in real-time via third-party APIs
• Aggregate, anonymized data may be used for service improvement

9. Third-Party Services

9.1 Integrated Services

The Service integrates with third-party services including:

• Authentication providers (Google, Apple)
• Payment processors (App Store, Play Store)

• We do not guarantee accuracy of weather data

11. Limitation of Liability

• Loss of profits, data, or goodwill
• Service interruption or data loss
• Unauthorized access to your data
• Any damages exceeding the amount you paid us in the 12 months preceding the claim

13. Termination
